How are the proposed Healthcare reform bills constitutional?

Somebody please explain to me again where in the Constitution of the United States the federal government is given the power to require private citizens to purchase a commercial product (in this case, health insurance) merely by fact of being a resident in the United States? It sure is not in the commerce clause.

I am NOT here arguing the desirability or undesirability of mandatory health insurance as public policy. That is a worthy debate for a different thread. I am only asking where the Constitution permits the government to make such a requirement the law of the land? And, if this is the case is there anything - anything at all - the federal government could not require citizens to buy or do if it so chose?

George Will writes that the US Supreme Court,

" ... says the constitutional privacy right protects personal "autonomy" regarding "the most intimate and personal choices." The right was enunciated largely at the behest of liberals eager to establish abortion rights. Liberals may think, but the court has never held, that the privacy right protects only doctor-patient transactions pertaining to abortion.... If government cannot proscribe or even "unduly burden" -- the court's formulation -- access to abortion, how can government limit other important medical choices? ...

... When asked whether any compulsory insurance purchases are constitutional, Speaker Nancy Pelosi was genuinely astonished: "Are you serious? Are you serious?" In 1803, in Marbury v. Madison, Chief Justice John Marshall wrote, "The powers of the legislature are defined and limited; and that those limits may not be mistaken, or forgotten, the Constitution is written."

I just saw my first tv commercial selling silver. It was compelling. I was ready to grab the phone and the credit card and order.

It said that the Chinese gov't has allowed the Chinese people to now own silver. (Didn't know it was a no-no) before.

It told me why silver is scarcer than gold. Supposedly all the silver mined in the last X number of years has been used in the production of what ever silver is used for. Every ounce.

AND they actually mail you the silver - not "certificates". And near the end of the commercial they show a guy opening his box of goodies when his silver shipment arrives.

Gold and silver could double and triple from here if you think about our massive debt, worthless currency and coming inflation. But then again - we may be nearing a top.

A failed presidency is now unavoidable

The NYT reports: "China held firm against most American demands. With China's micro-management of Mr. Obama's appearances in the country, the trip did more to showcase China's ability to push back against outside pressure than it did to advance the main issues on Mr. Obama's agenda, analysts said."

The Washington Post: "If there was any significant change during this trip, in fact, it was in the United States' newly conciliatory and sometimes laudatory tone. . . . Obama's trip stood in stark contrast to visits by his predecessors."

The Times stated that Obama was given "less respect than was given presidents Bush or Clinton."

John McCain may have been the Republican Party's national standard bearer last year, but now it looks like he may have a hard time just hanging on to his Senate seat.

A new Rasmussen Reports poll of likely 2010 GOP primary voters in Arizona finds the longtime incumbent in a virtual tie with potential challenger, J.D. Hayworth. McCain earns 45% of the vote, while Hayworth picks up 43%.

Another candidate, anti-illegal immigration activist Chris Simcox, is picking up 4%.

Hayworth, 51, a conservative former U.S. congressman who now is a popular radio talk show host in Phoenix, is reportedly interested in the race but has not formally declared for it.

Hayworth served in Congress from 1995 to 2006, when he lost a squeaker to Harry Mitchell, a one-time mayor of Tempe, AZ. During the campaign, Hayworth was dogged by his ties to controversial lobbyist Jack Abramoff, who with his clients donated money to Hayworth. He was also hounded over his decision to use his political action committee to pay his wife.

Here’s a case study.

On page 432 of the Reid bill, there is a section increasing federal Medicaid subsidies for “certain states recovering from a major disaster.” (Psst, Kentucky had a major disaster last year with no power and ice storms, might they get half of Mary Landrieus money???)

The section spends two pages defining which “states” would qualify, saying, among other things, that it would be states that “during the preceding 7 fiscal years” have been declared a “major disaster area.”

I am told the section applies to exactly one state: Louisiana, the home of moderate Democrat Mary Landrieu, who has been playing hard to get on the health care bill.

In other words, the bill spends two pages describing would could be written with a single world: Louisiana. (This may also help explain why the bill is long.)

Senator Harry Reid, who drafted the bill, cannot pass it without the support of Louisiana’s Mary Landrieu.

How much does it cost? According to the Congressional Budget Office: $100 million.

Anybody know what happened to the General after his retirement? I would not mind holding shares in a company that he had a high level management position or was on the board of directors. I would feel (corny) trust & integrity.

As opposed to four star Powell. Stormin Norman was in the field busting his ass and eating dust while Powell was giving briefings to the press and advising the President. I am sure Powell saw lots of combat in Nam as young looey or captain. But after that interview with Fareed what's his name on CNN earlier this year or last year - I kind of lost the respect I had for him. He sounded like politician or a weasel in that interview. I would NOT feel comfortable holding shares in a company that Powell had anything to do with.

Pud - it's not a race thing. It's more like loyalty to the Commander In Chief and not making your own ass look good to the left.

The furor over a federal panel’s recommendation against mammograms for most women in their 40s shows the obstacles the U.S. may face trimming costs in a $2.5 trillion health system, even when research suggests the cuts may be appropriate, said Uwe Reinhardt, a Princeton University economist.

With a health-care overhaul nearing a Senate vote, Republicans said the recommendations by the panel, the U.S. Preventive Services Task Force, for fewer mammograms proved Obama’s agenda will lead to rationed care. Democrats, fearful of antagonizing a key voting group in women, said the U.S. won’t change federal reimbursements to support guidelines that most women shouldn’t get regular mammograms until age 50.

The panel’s suggestions provided “the perfect place to throw a bomb into the health-care debate,” said Representative Lynn Woolsey, a Democrat of California and co-leader of the 82- member Congressional Progressive Caucus, in an interview. “We’re not going to ration anything. We’re going to give people choices based on science.”

‘Worst-Case Scenario’

The new guidelines would reduce annual mammograms by more than half under a “worst-case scenario,” said Junaid Husain, a Boston-based analyst at Soleil Securities, in a note to investors Nov. 17. Senator Sam Brownback, a Republican of Kansas, said the task force’s recommendations represent the start of an Obama administration plan to ration health care to pay for its overhaul.

I look in once in a while for "local on the 8's". Mark said I should use accuweather on the net - but I have slow dial up.

The weather channel is running long segments - maybe whole 1/2 hour "infomercials" on global warming. I have never heard them admit that this is NOT scientific fact. So ya got NBC & weather going green. Maybe even PSNBC? It looks like a left wing conspiracy. While watching the USA tv station, I have seen promos for shows with Pomposs Ass Tom Brokaw. Good grief - I hope NBC doesn't own USA tv. I watch a lot of shows there - like NCIS etc.

"...Critics storm that health care reform is “a cruel hoax and a delusion.” Ads in 100 newspapers thunder that reform would mean “the beginning of socialized medicine.”

The Wall Street Journal’s editorial page predicts that the legislation will lead to “deteriorating service.” Business groups warn that Washington bureaucrats will invade “the privacy of the examination room,” that we are on the road to rationed care and that patients will lose the “freedom to choose their own doctor.”

All dire — but also wrong. Those forecasts date not from this year, but from the battle over Medicare in the early 1960s. I pulled them from newspaper archives and other accounts.

Yet this year those same accusations are being recycled in an attempt to discredit the health reform proposals now before Congress. The heirs of those who opposed Medicare are conjuring the same bogymen — only this time they claim to be protecting Medicare.

Indeed, these same arguments we hear today against health reform were used even earlier, to attack President Franklin Roosevelt’s call for Social Security. It was denounced as a socialist program that would compete with private insurers and add to Americans’ tax burden so as to kill jobs.

Daniel Reed, a Republican representative from New York, predicted that with Social Security, Americans would come to feel “the lash of the dictator.” Senator Daniel Hastings, a Delaware Republican, declared that Social Security would “end the progress of a great country.”

John Taber, a Republican representative from New York, went further and said of Social Security: “Never in the history of the world has any measure been brought here so insidiously designed as to prevent business recovery, to enslave workers.”

In hindsight, it seems a bit ridiculous, doesn’t it? Social Security passed, and the republic survived.

Similar, ferocious hyperbole was unleashed on the proposal for Medicare. President John Kennedy and later President Lyndon Johnson pushed for a government health program for the elderly, but conservatives bitterly denounced the proposal as socialism, as a plan for bureaucrats to make medical decisions, as a means to ration health care.

The American Medical Association was vehement, with Dr. Donovan Ward, the head of the A.M.A. in 1965, declaring that “a deterioration in the quality of care is inescapable.” The president of the Association of American Physicians and Surgeons went further and suggested that for doctors to cooperate with Medicare would be “complicity in evil.”
