Hillary's Health Care plan, Unconstitutional

The person that wrote this is an attorney.

The Constitution is clear on this point, the federal government can only take actions that are specifically authorized by the Constitution. All other powers are reserved for the states or the people. Nowhere in that document do you see anything that can in be interpreted to allow the feds to tell you what you must purchase.

In her little talk yesterday Hillary drew a comparison to auto insurance. She said that states require people to purchase auto insurance before they can drive. This should come as no surprise, but she's wrong. The only time you can be required to purchase automobile insurance by a state government is IF you wish to drive an automobile on a state or government owned highway. You can own a car and drive it around your private property to your heart's content without buying insurance, or without wearing a seatbelt of having operating headlights, for that matter. Hillary's comparison is absurd, but I suppose it's the best she can do.  Read it all here

I hope that a computer is doing the censorship.... otherwise, this forum is done.

Good point about the elites and wealthy seeking healthcare, out of the country.

If Hillary gets in, we will have to got Asia, for our quality health care.

Every person in this country and Mexico, currently gets free care in the US if needed.  Tell me again, why this has to be changed?

Hillary wants the government to have more control of your life.  It is typical communist philosphy i.e.; if they are dependent on you, then you can control them.

You are right about Hilary and her goals.But....again....Republicans need to develope alternative(sorry for repeating that ad nauseam). If the only strategy we can come up with is to repeat how much we dislike Hilary we will be doing exactly the same thing Democrats did during last election...ABB didn't do it and ABH won't either.

In today's news is that Bush plans to veto Democrats proposal to increase funds for Children's Health Insurance Programs.I understand there are budgetary concerns(but on the other hand since when is Bush concerned about budget?) but this is a political suicide. And it is also wrong...there is no reason why this country shouldn't take care of its children

Nothing has to be changed in our health system.  Its fine just the way it is, at least for me and 90% of the population.  Altering something that works for 90% of the population so that the other 10% can get it, at the expense of the 90, is not smart in my mind.  The ten should be working to get better jobs that pay health insurance.

Fun Fact:  There are more MRI machines in Ohio than in the countries of France or Britain and almost twice as many as Canada.

milanh:

So we will have an interesting debate about constitution while suffering another defeat at the ballot box because we do not deal with issues people are interested in?

Count me out

Milan

I have a great respect for you and your opinions, Milan. Unfortunately, I disagree. If slavery or 100% taxes were popular, they would still be wrong.

I'll defend the Constitution before any and all political parties.

Universal Health Care is a real worthy goal of all Americans IMHO. And everyone else too. Don't you think it's odd that Canada, Britain, Germany and France have all been able to make this happen for all their citizens and we cannot? Do you really believe that we are just so better (or smarter or less socisalistic or whatever political name you wanna use)  by not having the best medicine available for everyone?  Our system supports pharma and insurance at the expense of the average American. It seriously needs to be fixed. Wake up. It's not about Democrats or Hilliary - it's about the human beings that live all around you. Like your sister, or father or cousin. Wake the heck up!!

I'm very awake...

However, that system of insurance and pharma support provides the world with the bulk of the new drugs out on the market today- in addition to the new technology.  If we were to wake up as you say, yes we would have "free" and "universal" coverage but no new drugs or technology that has been prolific this last decade.

Its easy to cover everyone in Germany, France or Canada like you say when you dont have to fund new r&d b/c you have America doing it for you!

Someone else needs to wake up!

Respect is mutual.....But I see it everyday.Young families doing everything right and struggling to buy insurance. This is not liberal propaganda.Average insurance for family of 4 is now over 12 thousand $/year.We can discuss HOW to do it but not WHETHER to do it.The cost of our healthcare is spiraling out of control......

There is nothing in Constitution that would prevent us from attempting a meaningful health reform

Milan, the Republicans may indeed have a political problem oposing the expansion of S-CHIP.  However, I disagee with your assertion that it is necessarily wrong to do so.  You wrote,

...there is no reason why this country shouldn't take care of its children.

I agree, Milan.

But I submit that there is also no reason why, in order to "take care" of the nation's children, the taxpayer should should be required to foot the bill for health care for children in families making $80,000 per year.  That would be one result (among other) of the current proposal put forth by the Democrats in Congress.

Actually, the constitution is not clear at all on that point, as nowhere in the constitution does it say that the Federal Government can only take actions that are specifically mandated by the constitution.

I find that kind of constitutional reading, which is in the minority, to be wholly disingenuous insofar as it is always utilized to support ones ideological position.  The beauty of our constitution is that as a document it is limited in its prescription, thus allowing us as human beings the freedom and flexibility to decide what is best.

After all, where in the constitution does it say the Federal Government can make abortions illegal or invade Iraq or...

Sola scriptura is shorthand for I am going to make my own opinions the law.

Hey, MWL.  Welcome back.  I was wondering if you would be so kind as to respond to the questions I posed to you yesterday on my Saddam/inspections  thread?  Thanks.
